1.      General Information

These Terms of Use (“TOU”) apply to your use of the Paralegal Association of Santa Clara County (“PASCCO”) website (“Site”). Before using our Site you must agree to these Terms of Use. PASCCO may change these TOU from time to time and by continuing to use our Site you accept and agree to be bound by all changes.

2.      Email

You may unsubscribe from periodic emails sent by PASCCO by sending an email requesting to be unsubscribed to pasccoinfo@yahoo.com, with the word “Unsubscribe” in the subject line.

3.      Intellectual Property Rights

All copyright, trademarks, design rights, patents and other intellectual property rights (registered and unregistered) in and on our Site and all content (including any applications) located on the Site shall remain the sole property of PASCCO or its licensors (which includes other users) may not be used in any commercial manner without the prior written consent of PASCCO.

You must not:

  • Republish material from our Site without prior written consent;
  • Sell or rent material from our Site;
  • Provide a public performance of any of our Site content;
  • Reproduce, duplicate, copy or otherwise exploit material on our Site content in any way except for your own personal, non-commercial use;
  • You also agree not to adapt, alter or create a derivative work from any of our content except for your own personal, non-commercial use; or
  • Redistribute any content from our Site, including onto another website.

If any content is made available for user redistribution, it may only be redistributed within your place of work / organization for internal use.

4.      Acceptable Use of the Site

You agree to use our Site for lawful purposes only and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Site. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content or disrupting the normal flow of dialogue within our Site.

You may not use our Site to send unsolicited commercial communications.

You may not use the content on our Site for any marketing related purpose without our express written consent.

5.      Restricted Access

We have restricted access to certain areas of our Site. We may in the future need to restrict access to parts (or all) of our Site and reserve full rights to do so. If, at any point, we provide you with a username and password for you to access restricted areas of our Site, you must ensure that both your username and password are kept confidential.

We also reserve the right to disable your user account at our sole discretion without explanation.

6.      User Generated Content

By contributing your views, comments and other communications, or pictures which may include discussion boards, blogs and other services that allow users to provide feedback, comment or content ("User Content") to the Site or social media profiles, you understand and acknowledge that this information is available to the public and grant PASCCO, free of charge, permission to use the material in any way we want (including modifying and adapting it for operational and editorial reasons).

Copyright of your contribution will remain with you and this permission is not exclusive and you can continue to use the material in any way including allowing others to use it.

In order that PASCCO may use your contribution, you confirm that your contribution is your own original work, is not defamatory and does not infringe any US or California laws, and that you have the right to give PASCCO permission to use your contribution.

PASCCO does not approve, endorse, or adopt any User Content, and PASSSO assumes no liability for any User Content submitted by you or others. You agree to indemnify PASCCO against all claims and liabilities resulting from User Content. Users who do not wish to have information they have made available via the Site published, copied and/or reprinted, should not post on the Site. Please note that other participants may use posted information beyond the control of PASCCO.

PASCCO retains the right to remove any content for any reason, including but not limited to, content that it deems threatening, demeaning, profane, obscene, a violation of intellectual property rights or privacy laws, off-topic, or otherwise injurious or illegal.

You acknowledge, consent and agree that PASCCO may access, preserve and disclose your account information and the User Content you have posted if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary in the sole opinion of PASCCO to: (a) comply with legal process; (b) enforce the TOU; (c) respond to claims that any Content violates the rights of third parties; (d) respond to your requests for customer service; or (e) protect the rights, property or personal safety of the Administrators, its Users and the public.

7.      Limited Warranties

PASCCO exercises its best efforts to maintain the timeliness, accuracy, and completeness of the contents herein. While all information presented on this web site is deemed reliable, PASCCO makes no representations or warranties as to its content. To the extent permitted by the applicable law, we disclaim all representations and warranties with respect to the Site and any material thereon, either express or implied, including but not limited to any implied warranties of merchantability or fitness for any particular purpose; in no event will we be liable for indirect, special, incidental or consequential loss or damage which may arise in respect of the Site, its use, or in respect of other equipment or property, or for loss of profit, business, revenue, goodwill or anticipated savings, even if we have been advised of the possibility of such loss.

This web site contains links to third party web sites. These links are provided as a convenience for its members, sponsors and site visitors. PASCCO makes no representation or warranties, express or implied, as to the content of any linked web site and is not responsible for the content or the privacy practices employed by these sites. Reference to any company, products, services, processes, hypertext links to third parties, publications or other information by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply an endorsement, sponsorship, approval or recommendation by PASCCO. Product and service information is the sole responsibility of each individual vendor.

8.      Limitation of Liability

PASCCO does not exclude liability for death or personal injury to the extent only that the same arises as a result of negligence for which we are liable or otherwise, will be limited as follows:

  • We will not be liable for any loss or damage due to the use of the information or products sold from this Site.
  • In the event that any exclusion or other provision contained in these TOUs be held to be invalid for any reason and we become liable for loss or damage that could otherwise have been limited, such liability shall be limited to $1.
  • We do not warrant that functions available on the Site will be uninterrupted or error free, that defects will be corrected, or that the server that makes the Site available is free of viruses and / or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements.
9.      Miscellaneous

Without prejudice to our other rights under these TOU, if you fail to abide by these terms when using our Site, we will take all necessary measures to ensure our protection including, but not limited to, informing relevant third parties such as your internet provider about the infringement(s). We will also inform law enforcement of any serious violation.

10.   Changes to the Term of Use

PASCCO may change these terms from time to time and so you should check these terms regularly. Your continued use of our Site will be deemed acceptance of the updated or amended terms. If you do not agree to the changes, you should cease using our Site immediately.

If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of California, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.

11.   Entire Agreement

These TOU, together with our Privacy Policy, make the entire agreement between you and us in relation to your use of our Site.

12.   Governing Law and Jurisdiction

These TOU and all use of our Site are governed by the laws of California. By using this web site and any information contained therein, the user submits to the exclusive jurisdiction of the state courts of Santa Clara County, California, to resolve disputes of any kind arising out of the user's reliance on the information on this web site, or any interaction with the sponsors involving said site.

The information contained in this web site, and any associated web sites, is provided as a service to the members of PASCCO and the Internet community, and does not constitute legal advice. PASCCO presents this web site with a good-faith representation that the information it contains is generally reliable.
